Denial of Medical Travel for Former AG a Serious Concern: Premila Kumar

MP Premila Kumar has expressed concern over the judicial decision denying former Attorney-General Aiyaz Sayed-Khaiyum the opportunity to travel abroad for urgent medical treatment.

In a statement issued today, Kumar said it was troubling that someone facing serious health issues had been denied the chance to consult with the very doctors who had previously treated him and possess critical knowledge of his medical history.

“Continuity of care is not a luxury—it is a cornerstone of effective medical treatment. In Mr. Sayed-Khaiyum’s case, seeking care from the same team of doctors could be vital to his recovery,” she stated. “Tragically, he has now reportedly suffered a mild stroke—an outcome that may have been preventable with timely access to specialized care.”

Kumar called on the judicial system to adopt a more compassionate and flexible approach in cases involving health-related travel, especially when the individual in question has not yet been convicted.

“The principle of ‘innocent until proven guilty’ must be upheld,” she said. “This includes ensuring a person’s fundamental human rights, such as the right to seek appropriate and timely medical attention, are protected.”

She emphasized that while the legal process is essential, it should not override the paramount value of human life.

“There must be mechanisms in place to urgently review and, where necessary, reverse such decisions. Surely, there are alternative safeguards that can be used to ensure legal proceedings continue without denying someone the care they urgently need.”

Kumar concluded by stating that the justice system must remain committed to protecting life and dignity, noting that the former Attorney-General’s situation serves as a sobering reminder of the consequences when compassion is absent from the law.
