FICAC Closes File on Suspended Corrections Commissioner Over Spouse's Appointment

The Fiji Independent Commission Against Corruption (FICAC) has concluded its investigation into a complaint regarding the appointment of a Nurse Practitioner within the Fiji Corrections Service (FCS), involving then Commissioner Dr. Jalesi Nakarawa.

The complaint centered on the appointment of Dr. Nakarawa’s spouse to the position, raising concerns over potential abuse of office and conflict of interest. However, after a comprehensive review of the matter—including an examination of supporting evidence and the legal framework—FICAC has found no criminal offence was committed.

According to FICAC, the decision was guided by Article 130(7) of the 2013 Constitution of Fiji, which grants the Commissioner of Corrections broad discretionary powers to appoint individuals to the FCS. The Commission noted that the position in question was publicly advertised and that a competitive interview process was conducted prior to the final appointment.

“In light of the available evidence, FICAC finds there is insufficient basis to support any criminal charge in this matter,” the Commission stated.

However, FICAC also emphasized the importance of ethical considerations and public perception in such appointments. While the law may permit such discretion, the involvement of close relations in official appointments can raise concerns about nepotism and erode public trust.

“To uphold transparency and safeguard public confidence, it is advisable that appointments involving immediate family members be referred to an independent authority, such as the line Minister, for review and endorsement,” the statement continued.

FICAC reiterated its ongoing commitment to promoting integrity, accountability, and ethical governance within all public institutions and urged public officials to exercise sound judgment in leadership roles.

The investigation into Dr. Nakarawa’s actions is now officially closed.
